The CAN-SPAM Act requires an email to clearly identify it as an advertisement unless the email is sent to the recipient who has affirmatively consented to receive such messages. Additionally, the message must contain a clear and conspicuous notice of the opportunity to decline to receive further commercial electronic messages from the sender. Finally, the electronic message must include a valid physical postal address of the sender. CAN-SPAM ACT OF 2003, 15 USC § 5(A).

There are two ways the Act defines affirmative consent depending on who sends the communication. The first definition includes situations where the recipient consents to receiving the email. With respect to this first definition, affirmative consent means, “the recipient expressly consented to receive the message, either in response to a clear and conspicuous request for such consent or at the recipient’s own initiative.” §3(1)(A). The second definition includes situations in which the email is received from a party other than the party to which the recipient communicated such consent. In this situation, the recipient must have been given “clear and conspicuous notice at the time consent was communicated that the recipient’s electronic email address could be transferred to such other party for the purpose of initiating commercial electronic mail messages.” §3(1)(B).

In the event United Equity Mortgage Corporation receives affirmative consent from a recipient to receive messages, United Equity Mortgage Corporation may send electronic commercial messages to the recipient. As noted above, affirmative consent means the recipient expressly consented to receive the electronic commercial message in a clear and conspicuous request for such consent. Receiving affirmative consent may be accomplished by simply including a question on the United Equity Mortgage Corp. prequalification form requesting the recipient to check a box indicating that the user “would like to receive news and information from United Equity Mortgage Corporation. Once consent is received, United Equity Mortgage Corporation may begin sending commercial electronic messages to the recipient. However, the commercial electronic message must contain a clear and conspicuous notice of opportunity to decline to receive further commercial electronic mail messages from the sender in the future. § 5(a)(5)(ii). Moreover, the commercial electronic mail message must contain a functioning email address to send this opt-out request to. After the recipient has opted-out of receiving United Equity Mortgage Corporation, United Equity Mortgage Corp. must comply with the request within ten business days. The following is an example of an opportunity to decline notice:

Finally, any commercial electronic message sent by United Equity Mortgage Corporation must contain United Equity Mortgage Corporation’s physical address. § 5(a)(5)(iii).
